with regard to D.lgs. n. 196/2003 (Code for Protection of Personal Data) that substituted law n. 675/1996, the use of the information that pertains to you will be based on the principles of correctness, legality and transparency and of the safeguard of your discretion and rights. with regard to article 13 of D.lgs. n. 196/2003 (previously art. 10 law 675/1996) of the above-mentioned law, therefore, we provide you with the following information:

1.	The data that you provide will be used, within the limits of the privacy laws, for the purpose of accessing the virtual community and the various information systems necessary for acquiring and distributing H2Onews Italia srl's various informational and/or multimedia products and services.

2.	Usage will take place on paper as well as electronically.

3.	The conferral of your first name, last name, address, identification number, business name, VAT number and telephone number is obligatory in order to be offered the services provided by H2Onews Italia srl and/or functions requested by you, and the refusal to provide this data could lead to a partial or total exclusion from the services offered by H2Onews Italia srl;

4.	The personal data provided by users that ask for informative material (bulletins, CD-ROMs, newsletters, annual reports, FAQs, etc.) are used only to carry out the requested service or function and are only given to third parties when necessary.

5.	The information systems and software procedures responsible for the functioning of the website of H2Onews Italia srl acquire, through the normal course of their work, some personal data whose transmission is implicit in the use of Internet communication protocols. The information gathered is not used to identify, but, by their nature, they could be used to identify users when coupled with data held by third parties. This category includes the IP address or computer domain name used by the user to access the site, URI (Uniform Resource Identifier) addresses from requested information, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the server response (positive, error, etc.), and other parameters relative to the operating system and information settings of the user. The use of session cookies (that are not memorized by the users computer and disappear when the browser closes) is strictly limited to the transmission of session identifiers (consisting of numbers randomly generated by the server) necessary to grant safe and efficient site navigation. The session cookies used by the website of H2Onews Italia srl avoid using information techniques that could potentially prejudice user navigation of the site and do not acquire identifying personal data from the user.

7.	The data will be communicated, with consent, to other subjects (commercial entities and associations) that share the goals set forth in the Statutes of H2Onews Italia srl, are related by partnership to H2Onews Italia srl, for commercial, informational and advertising purposes.

At all times you can exercise your rights with regard to the use of the data as stated by article 7 of the privacy Code (previously art. 13 of law n. 675/1996), in particular, you are able to ask to know of the existence of any use of data that applies to you; to obtain this information promptly in an intelligible manner and their creation, deletion, transformation into an anonymous form or the halting of data used in violation of the law; the updating, rectification or integration of the data; certification that the above-mentioned operations were performed knowingly by those to whom the data was communicated, with the exception of the case in which the fulfillment of such would be impossible or would require a disproportionate effort with regard to the safeguards provided by law; to oppose in all or in part, for legitimate reasons, the use of personal data that pertains to you, with regard to the scope of the collection.

Object: Distribution of programs by H2onews Italia srl

With regard to our request to be able to transmit your production,

It is permitted
 
 
   1. That H2onews Italia srl owns the original title of all the rights to use, transmit and distribute worldwide daily video services (henceforth called PILLS), lasting between 1’ and 5’ (1 minute and 5 minutes ) to the producer of the same and having, in such a quality, full ownership and use of such rights.

2. That our society has interests and has therefore requested to be able to transmit your PILLS for informative, cultural and disclosing purposes,

With the above being permitted,

OUR SOCIETY RECOGNIZES, IS INFORMED OF AND GUARANTEES THE FOLLOWING:

1 We guarantee that the PILLS produced by you will be transmitted exclusively by our Catholic Internet Site and/or Catholic Television Station and/or Catholic Radio Station

whose Catholic nature is certified by accepting this contract, and by declaring a willingness to provide any further documentation eventually requested by H2onews Italia srl.

2. We guarantee that the distribution channel that will be used to transmit your PILLS, including as referenced in Part 1 above, will be adapted in the entire program to a particular, moral correctness with regards to the Church and the Pope, and that consequently, no type of program of dubious morality on either will ever be transmitted.

3. We guarantee that access and distribution on our part of your PILLS will take place exclusively:

a. For Catholic Internet Sites, through access to your information system, through the use of a password provided by you, and the insertion on our internet site of a link to every single PILL that will redirect viewing to the same site of H2onews.

b. For Catholic Television Stations, through access to your information system, through the use of a password provided by you and the download of every single PILL.

c. For Catholic Radio Stations, through access to your information system, though the use of a password provided by you and the download of the audio tracks of every single PILL.

4. We are aware and we recognize that the choice of the PILLS to which our society will have access and will be able to distribute, will be exclusively among the PILLS available on your information system from the moment of our access, as stated in the preceding Article 3, and that no particular request will ever be advanced by our Society for viewing a PILL not present at the moment, for whatever reason, on your information system.

5. We guarantee that we will transmit each of your PILLS for a maximum period of 20 consecutive days from the day on which each individual PILL is created, according to your information system. We guarantee that, at the end of this period, your PILL will no longer be transmitted and will be completely removed from our archive.

6. We are aware and we recognize that H2onews Italia srl is able to ask us, at whatever time and even without a stated reason, to delete from our archives each individual PILL, even before the 20 days since the creation of the PILL as stated in the preceding Part 5, and we guarantee that our Society will immediately comply in the event of such a request.

7. We guarantee that our Society will transmit each and every one of your PILLS in its entirety and without modifying or altering the PILL. We recognize that the partial transmission of the PILLS is not granted, even for promotional or advertising purposes of the same. The only option available to us is the choice of audio tracks that will be selectable through your information system.

8. We guarantee that our Society will not extrapolate any part, no matter how small, of your PILLS, neither video nor audio, for the creation of any type of audio/video content or program for any reason.

9. We are aware that any use of a PILL different from those indicated in the present act, in whole or in part, is explicitly forbidden to our Society, and will render our Society culpable for damages to H2onews Italia srl or to third parties.

10. We guarantee that our Society will not interrupt any PILL with advertisements and that no advertising of any sort, even for our other programs or charitable and/or non-profit initiatives will be superimposed on the PILLS.

11. We guarantee that our Society will not sell nor distribute nor grant the use of the PILLS to third parties, nor will it grant to third parties the use of the password to access your information system, being culpable in contrary cases for consequent damages to H2onews Italia srl and to every third party having rights.

12. We are aware that, in consideration of the exclusive informative, cultural and religious purpose of the PILLS, the concession of the rights of transmission on the part of H2onews Italia srl is free.

We guarantee that our Society will freely transmit without charge, considering that the transmission of your PILLS is free, a promotional video for H2onews, provided by you, lasting 30.” This transmission will have:

14. We are aware and we guarantee that every violation on our part of the present act will make us culpable, with regards to H2onews Italia srl and every third party have rights to the PILLS, obliging us to repay all consequent damages even to third parties and to guarantee H2onews Italia srl against every trouble or claim on the part of eventual third parties, including judicial, caused or owed by the violation of the content of the present act.

15. We are aware and we guarantee that any obligation born from this present act does not create any association among the parties, nor will it be interpreted as a “joint-venture,” collective business or agency.

16. We are aware that we can ask H2onews Italia srl for technical information about access to the information system and use of the PILLS, but that H2onews Italia srl is not bound to supply any type of specific technical support.

17. We are aware and we recognize that the selection of the PILLS that will be transmitted by out Society, and their inclusion in our programming, is entirely the charge of our Society and that H2onews Italia srl is not in any way responsible for any contest by third parties for any inadequacy in artistic/technical quality or in the content of the PILLS.

18. We are aware that you have at any moment the discretionary and inspection-proof power to interrupt access to your information system and to interrupt, with immediate effect, even with a simple email, the authority to transmit your PILLS, without providing our society any reason or justification, the free nature of the service notwithstanding. We guarantee that in the event of such an interruption, we will no longer transmit your PILLS in any way, and we will delete every PILL still present in our archive. We guarantee that we will not consider you responsible for any damages that such an interruption of your service could cause our Society, or other third parties having rights.

19. We are aware that the applicable law in every obligation coming from this present act is Italian law and that any controversy relative to interpretation, execution, resolution of the present contract must be amicably shared by the parties. Such conciliation not being possible, the parties agree that the competent court for whatever controversy will be that of Rome, Italy, to the exclusion of any other, either competing or alternative.

20. We guarantee that our Society consents to the treatment and communication of personal data for the purpose of connection to the present declarations, including that information provided by us for access to the information system of H2onews srl, as provided by the Code for the Protection of Personal Data (D. Lgs. June  30, 2003, n. 196).
